Villa Fontaine Architectural Rules Summary

  

Architectural Changes Requiring Prior Board Approval

Interior Modifications (Require Prior Approval)

- Structural changes inside the Unit (including removal or alteration of walls, ceilings, or support structures).
- Modifications to mechanical, utility, or plumbing systems (HVAC, electrical, gas, or water systems).
- Floor coverings that fail to meet sound mitigation standards.
- The Board may require removal and replacement if the chosen flooring transmits excessive noise.
- Painting or surface treatments that may disturb hazardous materials (e.g., asbestos).
 Note: Owners may choose any color for interior painting, but safe procedures must be followed.


  

Exterior and Common Area Modifications (Require Prior Approval)

- Construction or placement of improvements (e.g., fences, walls, trellises, patios, patio covers, awnings, carports, pools, spas, landscaping).
- Excavation or demolition outside a Unit.
- Modifications for handicapped access (subject to removal when no longer needed).
- Painting, decorating, remodeling, or alterations to any Exclusive Use Common Area or Common Area.
- Window coverings: Must conform to Board-approved standards and have a white exterior-facing side.
- Enclosing patios or balconies: Not permitted.
- Any other modifications affecting the exterior appearance of the Unit.


  

Architectural Review Process & Timeline

Owners must submit a written architectural request for any changes requiring approval. The process includes:
1. Preparation of Submittal:
 - Prepare detailed plans and specifications showing: nature, kind, shape, color, size, height, materials, contractor information, and any other details required by the Board.
2. Submission:
 - Submit your request to the Association along with any required fee or construction deposit.
3. Architectural Committee Review (if applicable):
 - The Architectural Committee reviews your submittal and provides a written recommendation (approval or disapproval) to the Board and Owner within 30 days.
4. Board Review:
 - The Board will review the request within 30 days of the committee’s recommendation, or within 60 days of the Owner’s submission (whichever is sooner).
 - The Board will provide a written response explaining any disapproval.
5. Deemed Approval if No Response:
 - If the Board does not respond within 60 days of receiving the Owner’s request, the Owner may send a follow-up notice to the Board.
 - If the Board fails to respond within 30 days of that notice, the request is deemed approved.
6. Commencement and Completion:
 - Once approval is obtained (or deemed approved), work must begin promptly and be completed within a reasonable time.


  

Important Reminders

- No work may begin without written approval from the Board unless approval is deemed granted by the process above.
- The Board may adopt additional Architectural Rules from time to time, which will be distributed to Owners.
- Owners are responsible for compliance with applicable building codes, laws, and regulations.

- Architectural request must include the name and current license of the Contractor performing the work.
